Welcome to RestoreArc. These Terms of Service ("Terms") govern your access to restorearc.com (the "Site") and your purchase of our products. By using the Site or placing an order, you agree to these Terms.
1. Who we are. The Site is operated by RestoreArc ("we," "us," "our"). Contact: support@restorearc.com · RestoreArc, 3140 W. Main Street, Riverton, WY 82501, USA.
Drafting note (recommended): For an enforceable contract, name the operating entity, e.g., "operated by Mystic Urban LLC d/b/a RestoreArc." Left off for now per your instruction.
2. Changes. We may update these Terms; continued use after changes means you accept them.
3. Eligibility. You must be 18 or older to use the Site and buy our products.
4. Dietary-supplement notice. Our products are dietary supplements, not drugs. Statements have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. Read the label, use only as directed.
5. Products, availability & pricing. We describe products as accurately as we can but don't warrant they're error-free. Products are subject to availability; we may limit quantities, discontinue products, or change prices. Prices are in U.S. dollars unless stated; taxes and shipping show at checkout.
6. Orders & acceptance. Your order is an offer to buy. We may accept, decline, or cancel an order — including after it's placed — if we suspect fraud, a pricing/description error, or a violation of these Terms. If we cancel a paid order, we refund the amount charged.
7. Payment. By ordering, you authorize us (via our payment processor) to charge your payment method for the total, including taxes and shipping, and represent that you're authorized to use it.
8. Subscriptions / auto-renewal. We don't currently offer a subscription.
9. Shipping & risk of loss. Governed by our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier.
10. Returns, refunds & guarantee. Governed by our Refund & Return Policy (which includes our 90-Day Money-Back Guarantee), incorporated into these Terms.
11. Promotions & codes. Subject to their stated terms; can't be combined unless stated; no cash value; may be modified or withdrawn anytime.
12. Acceptable use. Don't use the Site unlawfully or fraudulently, breach its security, scrape it or use bots, or infringe anyone's rights. We may suspend or terminate access for violations.
13. Intellectual property. Site content (text, graphics, logos, product names, images, design) is owned by us or our licensors. You get a limited, personal, non-transferable license to view the Site for shopping; no other use of our content or trademarks without written permission.
14. Reviews & user content. If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and adapt it for our business and marketing, and you represent it's yours to share and doesn't violate anyone's rights. We may remove content at our discretion and don't endorse user content.
15. Third-party links. We don't control or endorse linked third-party sites and aren't responsible for them.
16. Disclaimer of warranties. To the fullest extent permitted by law, the Site and products are provided "as is" and "as available," and we disclaim implied warranties (merchantability, fitness for a particular purpose, non-infringement) except those that can't be excluded by law. Individual results vary; nothing here guarantees a specific outcome.
17. Limitation of liability. To the fullest extent permitted by law, we (and our owners, employees, and suppliers) aren't liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to a product or the Site won't exceed what you paid for the product at issue. Some jurisdictions don't allow these limits, so they may not fully apply to you.
18. Indemnification. You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
19. Governing law & venue. Governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Subject to Section 20, disputes will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
20. Dispute resolution. Before filing any claim, contact us at support@restorearc.com to try to resolve it informally.
21. General. Severability; entire agreement (these Terms plus referenced policies); no waiver by non-enforcement; you may not assign, we may; force majeure for events beyond our reasonable control; you consent to electronic communications.
